TessNew York is a trade name of MASSA LEGACY LLC. The name does not represent that we operate a physical shop, office, workshop, warehouse, or fulfillment center in New York.
SECTION 1 — ONLINE STORE TERMS
You must have the legal capacity to enter into a purchase contract. If you are under the age of majority where you live, a parent or legal guardian must place the order or authorize it as required by law.
You may not use our Services or products for an unlawful or unauthorized purpose. You must not transmit malicious code, interfere with website security, or violate applicable laws or the rights of others.
SECTION 2 — GENERAL CONDITIONS
We may refuse or restrict service where reasonably necessary because of suspected fraud, unlawful conduct, security risk, product unavailability, shipping restrictions, or a material breach of these Terms.
You may not reproduce, duplicate, copy, sell, resell, or commercially exploit any protected portion of the Services without our written permission or another lawful basis.
Information other than full payment-card details may travel through different networks and be modified to meet technical requirements. Card information is handled by authorized payment providers through encrypted connections.
SECTION 3 — ACCURACY AND TIMELINESS OF INFORMATION
We take reasonable steps to keep product descriptions, prices, availability, shipping information, and other website content accurate. General or historical content may not always reflect current conditions.
If an error or omission materially affects an order, we will notify you and provide the options required by applicable law, which may include confirming corrected information or cancelling the affected order for a refund.
SECTION 4 — SERVICES, PRICES, AND CONTRACT FORMATION
Prices and product availability may change for future purchases. Changes do not affect an order already accepted, except where an obvious error must be corrected in accordance with applicable law.
Product listings are invitations to place an order. By submitting an order, you make an offer to purchase the selected goods. An automatic confirmation acknowledges receipt but does not necessarily mean acceptance. A purchase contract is formed when we expressly accept the order or dispatch the goods.
We may decline or cancel an order before acceptance because of unavailability, an obvious price or description error, failed payment, suspected fraud, quantity limits, or a delivery restriction. Any payment collected for an order we cancel will be refunded.
SECTION 5 — PRODUCTS AND PRODUCT INFORMATION
Certain products are available exclusively online and may be offered in limited quantities. Product descriptions, photographs, measurements, materials, variants, and notices shown at the time of order form part of the purchase information.
We make reasonable efforts to display colors and images accurately, but screen settings and lighting may cause differences. We describe origin, manufacturing method, materials, and special characteristics only when supported by the relevant product information.
Products are checked, packed, and dispatched by our international fulfillment partner in Ningbo, China, unless a product page expressly states otherwise. Full delivery information appears in our Shipping Policy.
SECTION 6 — BILLING, PAYMENT, AND ACCOUNT INFORMATION
You agree to provide current, complete, and accurate order, billing, delivery, and account information. You are responsible for checking the product, size, color, quantity, and delivery address before submitting the order.
Available payment methods are displayed at checkout and may include Visa, Mastercard, Discover, Apple Pay, Google Pay, and Shop Pay. Payments are processed through Shopify Payments or the payment provider shown at checkout. We do not store full payment-card numbers or security codes.
We may limit quantities or decline orders reasonably identified as fraudulent, unauthorized, or intended for unauthorized resale. If we change or cancel an order, we will attempt to notify you using the contact details provided at checkout.
SECTION 7 — SHIPPING AND DELIVERY
We ship only to valid residential and business addresses in the United States. Processing normally takes 1–3 business days. International transit after dispatch from Ningbo, China, normally takes an estimated 7–15 business days, for an estimated total of 8–18 business days.
UPS normally handles final local delivery and tracking within the United States. An international logistics provider may transport the parcel before it enters the UPS network. Delivery times are estimates unless we expressly agree to a guaranteed date.
Standard shipping is free. TessNew York pays applicable customs duties, import taxes, brokerage fees, and import-clearance charges associated with a properly processed shipment. See our Shipping Policy for complete details.
SECTION 8 — TITLE AND RISK
Title remains with us until full payment to the extent permitted by law. Risk of loss transfers as required by the mandatory law applicable to the sale. Nothing in these Terms transfers carrier risk to a consumer earlier than permitted by law.
SECTION 9 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools or services supplied by third parties, including Shopify, payment providers, analytics platforms, and shipment-tracking services. Their use may be governed by additional terms and privacy policies.
Third-party tools may be provided on an “as available” basis. We do not limit liability that cannot legally be excluded.
SECTION 10 — THIRD-PARTY LINKS
The Services may contain links to websites operated by third parties. A link does not mean that we control or endorse all content, products, security measures, or practices of the linked service. Review the applicable terms before completing a transaction with a third party.
SECTION 11 — COMMENTS, REVIEWS, AND OTHER SUBMISSIONS
If you submit a review, image, comment, suggestion, or other material, you represent that you have the right to provide it and that it does not violate law or another person’s rights.
You grant us a non-exclusive, royalty-free license to host, reproduce, edit, and display the material for purposes connected with operating and promoting the store. We may remove material that is unlawful, deceptive, abusive, defamatory, privacy-invasive, infringing, or malicious.
SECTION 12 — PERSONAL INFORMATION
Our collection, use, and disclosure of personal information are described in our Privacy Policy and the privacy choices interface available on the website.
SECTION 13 — ERRORS, INACCURACIES, AND OMISSIONS
The website may occasionally contain typographical errors or inaccuracies relating to product descriptions, prices, promotions, availability, shipping costs, or delivery times. We may correct these errors and update the information.
If a correction materially affects an order already placed, we will notify you and provide the options required by applicable law.
SECTION 14 — PROHIBITED USES
You must not use the Services to:
- commit, encourage, or assist unlawful activity;
- infringe intellectual-property, privacy, publicity, or other rights;
- submit false, deceptive, defamatory, abusive, or discriminatory material;
- transmit malicious code or interfere with website security;
- collect personal information without a lawful basis;
- send spam, conduct phishing, impersonate another person, or commit fraud; or
- use automated tools in a way that harms or disrupts the Services.
We may suspend or terminate access where reasonably necessary to address a violation.
SECTION 15 — WARRANTIES AND LIABILITY
Mandatory statutory warranties, implied warranties, consumer protections, product-liability rules, and remedies that cannot be waived remain fully effective.
We do not guarantee that the website will always be uninterrupted or error-free, particularly during maintenance, service-provider failures, or events outside our reasonable control.
We do not exclude or limit liability where doing so is prohibited by law, including liability for fraud, willful misconduct, gross negligence where applicable, personal injury caused by negligence, mandatory product liability, or non-waivable consumer rights. Any other limitation applies only to the maximum extent permitted by applicable law.
SECTION 16 — INDEMNIFICATION
To the extent permitted by law, you are responsible for actual losses and reasonable costs resulting from your unlawful use of the Services, deliberate breach of these Terms, or infringement of another person’s rights. This provision does not impose obligations on a consumer beyond those permitted by applicable law.
SECTION 17 — SEVERABILITY
If any provision is found invalid or unenforceable, the remaining provisions continue to apply. Mandatory law replaces the affected provision where required.
SECTION 18 — TERMINATION
You may stop using the website at any time. We may suspend or terminate access where reasonably necessary because of a material violation of law, these Terms, or website security.
Termination does not affect rights and obligations that arose earlier, including accepted orders, payments, returns, refunds, or legal claims.
SECTION 19 — ENTIRE AGREEMENT
These Terms, together with the product information shown at purchase, checkout terms, Privacy Policy, Shipping Policy, and Return and Refund Policy, form the agreement governing use of the store and purchases from us.
Our failure to enforce a provision does not waive the right to enforce it later.
SECTION 20 — GOVERNING LAW
To the extent permitted by law, these Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. This choice does not deprive a consumer of mandatory protections or courts available under the law of the state or jurisdiction where the consumer resides.
SECTION 21 — RETURNS, REFUNDS, AND CANCELLATIONS
We offer a voluntary 30-day return period beginning on the date of delivery. The customer pays the direct international return cost for a change of mind or an incorrectly selected size or color. Tess New York pays reasonable return costs for a confirmed incorrect, damaged, or defective item.
Contact us immediately if you wish to cancel or change an order. Cancellation or modification is possible only before processing begins. Complete conditions, exclusions, return instructions, and refund timing appear in our Return and Refund Policy.
SECTION 22 — CHANGES TO THESE TERMS
The Terms in effect when an order is placed apply to that order. We may update these Terms for future use when our Services, practices, or legal obligations change. The current revision date appears at the top.
